Welcome to NeuroDrive. These Terms & Conditions govern your access to and use of the NeuroDrive website, platform, applications, assessments, training tools, content, and related services.
By accessing or using NeuroDrive, you agree to these Terms. If you do not agree, please do not use the services.
1. About NeuroDrive
NeuroDrive provides tools designed to help athletes, coaches, teams, academies, and organizations assess, understand, train, and track aspects of neuro-performance.
NeuroDrive is intended to support athlete development and coaching. It is not a medical service and is not intended to diagnose, treat, cure, or prevent any medical condition.
2. Eligibility and accounts
Some NeuroDrive services require an account.
You are responsible for providing accurate information, maintaining the confidentiality of your login credentials, and ensuring that activity conducted through your account is authorized.
Organizations are responsible for determining which coaches, administrators, athletes, or other individuals are permitted to access their NeuroDrive accounts and information.
Where an athlete is under the applicable age of majority, use of the platform may require authorization from a parent, guardian, team, school, or other responsible organization as required by applicable law.
3. Athlete assessments and performance information
NeuroDrive assessments, scores, recommendations, training activities, and other insights are intended to provide information related to athlete development.
Results should be interpreted within the broader context of the athlete, their sport, training environment, and professional judgment.
Assessment results may change over time and should not be interpreted as permanent measures of an athlete's ability, potential, health, or future performance.
4. Not medical advice
Information provided through NeuroDrive is for performance-development and informational purposes.
NeuroDrive does not provide medical diagnosis, treatment, rehabilitation, emergency care, or other medical services.
Nothing provided through NeuroDrive should replace advice from a qualified physician, healthcare professional, athletic therapist, physiotherapist, psychologist, or other appropriately qualified professional where such advice is required.
If an athlete is experiencing symptoms, injury, illness, or another health concern, appropriate professional medical advice should be obtained.
5. Use of the services
You agree to use NeuroDrive lawfully and for its intended purposes.
You may not:
Attempt to gain unauthorized access to NeuroDrive systems, accounts, or data
Misrepresent your identity or authority
Interfere with the security or operation of the services
Copy, reverse engineer, reproduce, scrape, or commercially exploit the platform except where expressly permitted
Upload malicious software or harmful material
Use athlete information for unauthorized purposes
Use NeuroDrive in a way that violates applicable law or the rights of another person
6. Organizations and authorized users
Teams, clubs, academies, schools, and other organizations may provide access to NeuroDrive for athletes, coaches, staff, and administrators.
Organizations are responsible for managing authorized users and ensuring they have appropriate authority, consent, and permissions to enter, access, and use athlete information.
NeuroDrive may provide different levels of access depending on a user's role.
7. Intellectual property
The NeuroDrive platform and its associated technology, software, interfaces, assessment systems, training systems, designs, graphics, trademarks, logos, text, methodologies, and other content are owned by or licensed to NeuroDrive and are protected by applicable intellectual property laws.
Using NeuroDrive does not transfer ownership of any NeuroDrive intellectual property to you.
Unless expressly authorized, NeuroDrive materials may not be reproduced, modified, distributed, sold, licensed, or commercially exploited.
8. Feedback
If you provide suggestions, comments, ideas, or other feedback regarding NeuroDrive, we may use that feedback to develop and improve our products and services without restriction or obligation to compensate you.
We will not treat feedback as confidential unless otherwise agreed.
9. Third-party services
NeuroDrive may rely on or integrate with third-party technology, hosting, communication, analytics, payment, authentication, or other services.
Those services may be governed by their own terms and privacy practices.
NeuroDrive is not responsible for third-party products or services that are outside our reasonable control.
10. Availability and changes
We work to make NeuroDrive reliable and useful, but we do not guarantee that the platform will always be available, uninterrupted, error-free, or compatible with every device or system.
We may update, modify, improve, replace, suspend, or discontinue portions of NeuroDrive as the platform evolves.
Features described on our website may differ from features currently available to particular users, organizations, or subscription plans.
11. Accuracy of information
We aim to provide accurate and useful information, but NeuroDrive assessments and insights involve complex human performance data and should not be viewed as guarantees of athletic performance or outcomes.
Individual results may be influenced by numerous factors, including environment, fatigue, motivation, physical condition, test conditions, and participation.
12. No guarantee of results
Use of NeuroDrive does not guarantee improved athletic performance, selection to a team, competitive success, injury prevention, scholarship opportunities, professional advancement, or any other particular outcome.
Training and development outcomes differ between individuals.
13. Privacy
Our collection and use of personal information is described in our Privacy Policy.
By using NeuroDrive, you acknowledge that personal information may be processed as described in that policy.
14. Suspension or termination
We may suspend or restrict access to NeuroDrive where reasonably necessary to protect users, athlete information, the integrity of the platform, or NeuroDrive's legal rights.
Access may also be terminated where these Terms are materially violated or where an applicable subscription, agreement, or organizational relationship ends.
15. Disclaimer
To the extent permitted by law, NeuroDrive and its services are provided on an "as available" basis.
We do not make guarantees regarding specific performance outcomes, uninterrupted availability, or the suitability of NeuroDrive for every athlete, organization, sport, or purpose.
Nothing in these Terms excludes rights or protections that cannot legally be excluded.
16. Limitation of liability
To the maximum extent permitted by applicable law, NeuroDrive will not be liable for indirect, incidental, special, consequential, or similar damages resulting from the use of, or inability to use, NeuroDrive.
Any additional liability provisions applicable to organizations purchasing or licensing NeuroDrive may be addressed in their applicable service agreement or commercial contract.
17. Changes to these Terms
We may update these Terms as NeuroDrive and its services evolve.
When material changes are made, we will update the effective date and provide additional notice where appropriate.
Continued use of NeuroDrive after updated Terms take effect constitutes acceptance of those Terms where permitted by law.
18. Governing law
These Terms are governed by the laws of British Columbia and the applicable federal laws of Canada, unless another jurisdiction is required by law or agreed to in a separate written agreement.
