PLATFORM

Acceptable Use Policy

This Policy applies to everyone who uses the NeuroDrive Platform, including organizations, coaches, assistant coaches, administrators, athletes, parents, and guardians. Where you access the Platform through an organization, your organization is also responsible for your compliance with this Policy.

1. THE CORE RULE

Athlete data belongs to the athlete and their family. Use it to help that athlete develop. Do not use it for anything else, and do not take it out of the Platform.

2. ACCOUNTS AND CREDENTIALS

You will:

(a)  keep your username and password confidential and not share them with anyone;

(b)  not use anyone else's account, and not allow anyone to use yours;

(c)  not create an account for another person without their authority, or for an athlete without the consent required under the Agreement;

(d)  use a device that is protected by a passcode, and lock it when unattended; and

(e)  tell NeuroDrive immediately if you think someone else has accessed your account.

3. ATHLETE DATA

You will not:

(a)  access the results, profile, or training information of any athlete other than one you are authorized to see;

(b)  export, download, screenshot, photograph, copy, or transcribe athlete results out of the Platform, except where the Platform provides an export function and you are authorized to use it;

(c)  store athlete results on a personal device, personal email account, personal cloud storage, or any system outside the Platform;

(d)  share athlete results with anyone outside your organization, including other clubs, scouts, recruiters, agents, prospective schools, sponsors, media, or other parents;

(e)  post athlete results, scores, or profiles to social media or any public forum, including in aggregate or ranked form;

(f)  compare, rank, or display athletes' results to other athletes or to other families;

(g)  attempt to identify any individual from de-identified or aggregate information; or

(h)  continue to access athlete data after you cease to hold your role with the organization.

3.1  If you leave. When you stop coaching or administering for an organization, your access ends. Delete any material you hold outside the Platform and confirm to your organization that you have done so.

4. HOW RESULTS MAY AND MAY NOT BE USED

4.1  Permitted. Assessment results, NeuroScores, and performance profiles may be used to help an individual athlete understand their own performance, to inform that athlete's training, and to plan development activity within your organization.

4.2  Not permitted. You will not use assessment results, NeuroScores, or performance profiles:

(a)  for any medical, diagnostic, screening, or clinical purpose;

(b)  to detect, assess, or monitor concussion, head injury, or any other injury or condition;

(c)  to make or inform any return-to-play, return-to-training, or medical clearance decision;

(d)  to assess or predict injury risk;

(e)  [to decide, or to help decide, an athlete's team selection, roster position, or playing time;]

(f)  to recruit, evaluate, or promote an athlete to any third party; or

(g)  in any way that could embarrass, disadvantage, or single out an athlete.

4.3  If an athlete is injured. If you are concerned that an athlete has been injured or is unwell, follow your organization's medical protocol and your sport's requirements. Do not use NeuroDrive to assess them and do not treat any NeuroDrive result as relevant to that decision.

5. CONDUCT

You will not:

(a)  upload any image of an athlete without a signed release from that athlete's parent or guardian;

(b)  upload content that is unlawful, harassing, abusive, discriminatory, defamatory, or otherwise inappropriate in a setting involving children;

(c)  record notes about an athlete that you would not be willing for that athlete and their parent or guardian to read;

(d)  use the Platform to contact an athlete for any purpose unrelated to their development within your organization; or

(e)  represent that you are certified, qualified, or endorsed by NeuroDrive beyond what is accurate.

6. TECHNICAL RESTRICTIONS

You will not:

(a)  copy, modify, or create derivative works of the Platform;

(b)  reverse engineer, decompile, or attempt to derive the Platform's source code, scoring methodology, or assessment protocols;

(c)  use automated tools to access, scrape, or extract data from the Platform;

(d)  probe, scan, or test the security of the Platform, or circumvent any access control or usage limit;

(e)  introduce malware or any harmful code;

(f)  interfere with or place undue load on the Platform or the infrastructure supporting it; or

(g)  use the Platform to build or assist in building a competing product.

6.1  Security research. If you believe you have found a security vulnerability, report it to [security@neurodrive.com] rather than testing it further. NeuroDrive will not pursue a claim against anyone who reports a vulnerability in good faith, does not access or alter data belonging to others, and gives NeuroDrive a reasonable opportunity to remediate before disclosing it.

7. REPORTING CONCERNS

7.1  Privacy. Report a suspected breach of this Policy, a lost device, or unauthorized access to [privacy@neurodrive.com] and to your organization.

7.2  Athlete safety. If you have a concern about an athlete's safety or wellbeing, follow your organization's safeguarding policy and report to the appropriate authority where the law requires. Do not delay a report to an authority in order to consult NeuroDrive.

8. ENFORCEMENT

8.1  NeuroDrive may suspend or terminate access for any individual or organization that breaches this Policy, and may do so immediately and without notice where there is a risk to an athlete's safety or privacy or to the security of the Platform.

8.2  NeuroDrive will notify the relevant organization of any suspension and will limit the suspension in scope and duration to what is reasonably necessary.

8.3  Nothing in this Section limits any other right or remedy available to NeuroDrive or to an organization.

9. CHANGES TO THIS POLICY

NeuroDrive may publish new versions of this Policy. For organizations, changes take effect in accordance with the version freeze provisions of the Order Form. For individual users, changes take effect on notice at next login.
